Additional Terms - Generative AI

1. These Additional Terms are incorporated into your Contract in accordance with clause 15 of the Pendula Terms.
2. These Additional Terms apply to your use of the generative AI (Gen-AI) components of the Pendula Services (such as Pendula Gen-AI Tasks).
3. The Gen-AI technology is designed to provide information and assistance based on user input. However, the accuracy, completeness and reliability of the information generated by Gen-AI technology cannot be guaranteed. You should independently verify any information provided by Gen-AI technology before relying on it or including that information in any communications. To the extent permitted by law, Pendula Solutions is not liable (including, but not limited to, in negligence) for any errors, omissions or inaccuracies in the information generated by the Gen-AI technology or for any other liability arising out of or in connection with your use of the Gen-AI technology. You assume full responsibility for any actions taken based on the output of Gen-AI technology and agree to hold Pendula Solutions harmless in relation to any liability arising from your (including any of your users’) use of the Gen-AI technology. You are responsible for ensuring that use of the Gen-AI technology complies with all applicable laws and regulations. You are responsible for recording your own prompts as these may not be retrievable from the Pendula Platform. You must ensure that the Gen-AI technology is not used for any unlawful or harmful activities.
4. The Gen-AI technology is provided to Pendula Solutions by OpenAI, L.L.C. pursuant to the OpenAI Business Terms at https://openai.com/policies/business-terms/ and the terms and policies referred to therein (together, the OpenAI Terms). You agree to take all actions necessary to ensure Pendula Solutions’ compliance with the OpenAI Terms when you are using the Gen-AI technology in the Pendula Services. You acknowledge and agree to the limitations and disclaimers in relation to the Gen-AI technology described in the OpenAI Terms.
5. The use of Gen-AI technology may involve the collection and processing of Personal Information and/or Personal Data which may be provided to Open AI. You agree to procure all permissions and make all disclosures necessary to allow Open AI to obtain, use and disclose that Personal Information and/or Personal Data in accordance with its privacy policy at https://openai.com/policies/privacy-policy/.
